Terms of Service

These terms are an agreement between you and [LEGAL ENTITY NAME], [STREET, POSTCODE CITY, COUNTRY] ("Gymly", "we", "us"), for the use of the Gymly gym management software at https://gymly.shop (the "Service"). By creating an account or using the Service you accept these terms. If you accept them for a business, you confirm you may bind that business.

1. The Service

Gymly is software for running a gym: members, memberships, check-ins, payments, invoices, staff, reports and a member portal. The account holder ("Customer", usually the gym owner) controls the organization in Gymly, its locations, and which staff and members have access.

2. Accounts

  • You must give accurate information and keep your sign-in details secret. You are responsible for what happens under your account and the accounts you create for staff and members.
  • You must be at least 18 years old to create an organization.
  • Tell us at [support@gymly.shop] straight away if you think your account has been misused.

3. Plans, payment and renewal

  • Gymly has a free plan and paid plans. Each plan's features, limits and prices are shown on our website and in the app.
  • Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
  • Paid plans are billed in advance, monthly or yearly, and renew automatically for the same period until you cancel. Prices may include VAT or sales tax as shown at checkout.
  • You can cancel at any time in Settings → Billing. The plan stays active until the end of the period you have paid for, and is not renewed after that. Your organization then moves to the free plan.
  • When you change plans, Paddle charges or credits the difference for the rest of the current period.
  • We may change prices with at least 30 days' notice by email. A new price applies from your next renewal; you can cancel before it does.
  • Refunds are covered by our Refund Policy.

4. Your data

The data you and your staff enter into Gymly, including the personal data of your members ("Customer Data"), belongs to you. You give us permission to store and process it only to provide the Service. For Customer Data that is personal data, you are the controller and we are your processor, as described in our Privacy Policy. You are responsible for having a lawful basis to collect your members' data and for telling them how you use it.

5. Acceptable use

You must not:

  • break the law, or use the Service to store or send content that is unlawful, harmful or infringes other people's rights;
  • send spam or unsolicited messages through the email or WhatsApp features;
  • try to access other organizations' data, probe or attack the Service, or get around its limits or security;
  • resell, copy or reverse engineer the Service, except where the law allows it.

We may suspend accounts that break these rules, after warning you when we reasonably can.

6. Availability and changes

We work to keep the Service available and your data safe, but we do not guarantee uninterrupted or error-free operation. We may change or improve features. If we remove a major feature of a paid plan, we will tell you in advance and you may cancel and get a pro-rata refund for the unused part of your period.

7. Ending the agreement

You can stop using the Service and ask us to delete your organization at any time by writing to [support@gymly.shop]. Before you leave you can export your members and reports from the app. We may end this agreement with 30 days' notice, or immediately if you seriously break these terms. After an organization is closed we delete its Customer Data within 90 days, except what we must keep by law.

8. Liability

The Service is provided "as is". To the extent the law allows, we are not liable for indirect or consequential loss, such as lost profits, revenue or data, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law, including for fraud, or for death or personal injury caused by negligence, or your rights as a consumer.

9. Changes to these terms

We may update these terms. We will tell you about important changes by email or in the app at least 30 days before they take effect. If you keep using the Service after that, you accept the new terms.

10. Law and contact

These terms are governed by the law of [COUNTRY], and its courts have jurisdiction, without taking away any protection the law of your own country gives you as a consumer. Questions: [support@gymly.shop].
